Is your Paris rent legal? The method to check in 10 minutes

You’ve signed your lease and you still have doubts about your rent amount? In Paris, rent control (encadrement des loyers) is not just a recommendation, it is a strict rule that protects your purchasing power. And yet, many tenants don’t know how to check whether their rent complies with rent control in Paris, letting sometimes significant overcharges slip through. At APPARTE, we believe transparency is the foundation of a healthy landlord-tenant relationship. Here is the step-by-step method to check in under 10 minutes.

1. Gather the key information about your home

To carry out a reliable check, you need to gather four specific pieces of information. Without them, the official simulator cannot give you an accurate result. You will need:

  • The exact address of your home.
  • The building’s construction period (before 1946, 1946-1970, 1971-1990, or after 1990).
  • The number of main rooms (note: a kitchen or bathroom does not count).
  • The type of let: unfurnished or furnished.

These criteria are decisive, because the upper reference rent (loyer de référence majoré) varies according to these precise characteristics. A mistake on the construction period can throw off your entire calculation.

2. Use the City of Paris’s official simulator

Forget rough estimates found on third-party websites. The only reliable source is the City of Paris’s official simulator. It incorporates the data from the prefectoral order (arrêté préfectoral) currently in force, namely the one dated 12 June 2026, which applies to leases signed since 1 July 2026.

Enter your details and compare the result with your base rent excluding service charges. If your rent is higher than the upper reference rent, you may be facing an illegal overcharge.

3. Check your lease: the rent supplement trap

If your rent exceeds the cap, check your lease straight away. Has the landlord justified this excess with a rent supplement (complément de loyer)?

This supplement is only legal if the property has exceptional comfort or location features that are not taken into account in calculating the reference rent (for example, an unobstructed view of the Seine or a high-end terrace). Note that these features must be spelled out in the lease. If the supplement is vague or unjustified, it can be challenged. To go further on this point, see our article on unfair rent supplements.

4. What can you do if your rent is over the cap?

If you confirm that your rent is out of line, do not remain passive. There is a set procedure:

  • A formal notice (mise en demeure): Send a registered letter with acknowledgement of receipt to your landlord or the letting agency requesting that the rent be brought into compliance.
  • The Départemental Conciliation Commission (CDC): If the landlord refuses, refer the matter to the CDC. This is a free step that is often effective in reaching an amicable agreement.
  • The judge: As a last resort, the consumer protection tribunal (juge des contentieux de la protection) can be asked to order a rent reduction and the refund of any amount overpaid.

Note that you have three months from the date the lease was signed to bring a claim challenging a rent supplement.

The APPARTE approach: plan ahead rather than suffer the consequences

At APPARTE, we believe the best defence is prevention. As a property consultancy, we automatically rule out any listing that does not comply with rent control. This means our clients never find themselves in a dispute or facing complex procedures. We analyse every property to make sure the rent asked is not only legal, but also consistent with the market.

If you are looking for a home in Paris, don’t waste time on questionable listings. We help secure your search from the very start. To find out more about our method, discover our tips for succeeding in your rental search in Paris in 2026.

FAQ: Your questions about rent control

Does the upper reference rent include service charges?

No, definitely not. Rent control applies only to the base rent, excluding service charges. Service charges are a separate amount that must be justified by the landlord.

What happens after November 2026?

The current rent-control trial scheme in Paris is due to expire on 23 November 2026. Although the scheme is widely supported, its future will depend on upcoming legislative decisions. It is therefore crucial to check the rules in force at the time you sign your lease.

Can I report an overcharge anonymously?

The City of Paris has set up a dedicated service for reporting rent overcharges. This reporting allows the authorities to check on landlords’ practices and, where appropriate, to order them to refund any overpayment.
